JP MP Kashem obtains SC stay order

The Supreme Court yesterday allowed Jatiya Party (JP) lawmaker Abul Kashem to file an appeal with this court against a High Court judgement that had declared his parliamentary membership illegal and void. A five-member bench of the Appellate Division headed by Justice MA Matin passed the order after granting a leave to appeal petition filed by Abul Kashem challenging the HC verdict. The apex court also ruled that its chamber judge's order that stayed the HC verdict would continue till hearing on the appeal. Kashem was elected from Tangail-5 constituency on securing JP ticket in the December 29, 2008 national elections. On December 15 last year, the High Court in a verdict declared his parliamentary membership illegal and void and also directed the chief election commissioner to declare BNP candidate Maj Gen (retd) Mahmudul Hasan elected in the constituency since he got the second highest number of votes. Following a petition filed by Kashem, chamber judge of the Appellate Division stayed the HC verdict on December 17, last year and also asked Kashem to file a regular leave to appeal with the Supreme Court against the High Court verdict within six weeks. Barrister Rokan Uddin Mahmud appeared for Kashem.
