Oath-taking of two new judges still uncertain
The responsibility of swearing-in of the two new additional judges of the High Court will go to the shoulder of the next chief justice if any step is not taken to resolve the crisis within this month.
Chief Justice Mohammad Fazlul Karim will retire on September 30 this year. If Fazlul Karim does not administer oath to the two judges within his tenure, the responsibility will lie on the new chief justice.
Attorney General Mahbubey Alam recently told The Daily Star that if the present chief justice does not administer oath to two High Court judges--Ruhul Quddus Babu and M Khasruzzaman, the next chief justice might administer them oath.
He, however, said he does not know whether there was any initiative from the government or the chief justice to resolve the crisis.
Meanwhile, Law Minister Shafique Ahmed has not yet met the president to solve this crisis as per advice of the parliamentary standing committee on the law, justice and parliamentary affairs ministry.
Advocate AM Amin Uddin, a former secretary of the Supreme Court Bar Association (SCBA), recently told The Daily Star that Chief Justice Mohammad Fazlul Karim had assured them of solving the problem regarding oath of the two judges, but they did not get any information about any step of the chief justice.
He hoped that the present chief justice would administer oath to Ruhul Quddus and Khasruzzamn within his tenure.
Law Minister Shafique Ahmed has not yet met President Zillur Rahman although the parliamentary standing committee on law, justice and parliamentary affairs ministry at a meeting on May 24 this year, asked the law minister to meet the president within three days to resolve the matter.
The law minister recently told this correspondent that he did not feel necessary to meet the president in this regard, as their appointments are still valid.
President of the SCBA Khandaker Mahbub Hossain in July told this correspondent that the government should cancel the two judges' appointment for the sake of the judiciary.
Lawyers of the country would not accept it if the chief justice administer oath to these two "controversial" persons, he said.
Justice Fazlul Karim swore in 15 of the 17 newly appointed HC additional judges on April 18, leaving out the two considering “unavoidable circumstances.”
The crisis over swearing-in of the two judges has not been resolved since their appointment on April 11 by the president.
