SC adjourns hearing on leave-to-appeal till December 6
The Supreme Court yesterday adjourned hearing till December 6 on the leave-to-appeal petitions filed by the government against the High Court judgment that had acquitted six army personnel in the jail killing case.
A three-member bench of the Appellate Division headed by Chief Justice ABM Khairul Haque gave the verdict.
During yesterday's hearing, the Appellate Division asked the state counsel Anisul Huq to produce before it the documents and evidence in accordance with his claim that the lower court was influenced for the acquittal of the accused six.
The apex court said it does not want to pass any extra ordinary order without examining proper documents and evidence.
The court will consider the prayer for retrial of the case, if documents and evidence are placed before it, it said.
Earlier in the day, Attorney General Mahbubey Alam prayed to the court to send the case to the lower court for its retrial.
On August 28, 2008, the HC acquitted the six of the charge of killing national leaders Syed Nazrul Islam, Tajuddin Ahmad, AHM Qamaruzzaman, and Captain Mansur Ali in Dhaka Central Jail on November 3, 1975.
Earlier, on October 20, 2004, a Dhaka court had sentenced three to death, awarded life imprisonment to 12 and acquitted five in the case.
