SC upholds order of chamber judge

The Supreme Court (SC) yesterday upheld its chamber judge's order that stayed a tribunal verdict directing the Election Commission (EC) to reinstate 85 upazila election officers. The election officials, appointed during the last BNP-Jamaat alliance government, cannot be reinstated now following the SC order. The Administrative Appellate Tribunal on April 12 this year, in a verdict, directed the EC to reinstate 85 upazila election officers. The EC terminated the election officials during the regime of military-backed caretaker government on the grounds that they were appointed on political consideration. Following a petition filed by the government, the chamber judge of the Appellate Division on June 25 stayed the tribunal's verdict and asked the government to file a regular leave to appeal petition with the court. A three-member bench of the Appellate Division headed by Chief Justice ABM Khairul Haque yesterday passed the order after granting the leave to appeal petition recently filed by the government against the Administrative Appellate Tribunal's verdict. The apex court permitted the government to move a regular appeal with this court against the tribunal's judgement. It fixed February 22 next year for hearing the regular appeal and said the chamber judge's order will continue till the disposal of the appeal. Attorney General Mahbubey Alam appeared for the government and Advocate Salahuddin Dolon argued for the election officers.
