SC paves way for Bangabandhu Tower

The Supreme Court has paved the way to start construction of Bangabandhu Tower, a 20-storey residential building for Dhaka University's fourth-class employees, in Shivbari area on DU campus. The chamber judge of the Appellate Division of SC yesterday stayed for eight weeks a High Court order that imposed an injunction on the construction of the tower. Justice MA Wahhab Miah, the chamber judge, passed the order after hearing a petition filed by DU authorities on June 24 seeking a stay on the HC order. The judge asked the DU authorities to file a leave to appeal petition with the SC against the HC order in eight weeks. Advocate AFM Mesbahuddin, chief counsel for DU, told The Daily Star that there is no legal bar for his client to start constructing the tower following the SC order. He said that the HC on May 28, following a writ petition, imposed an injunction for six months on construction of the tower and filling up a pond at Shivbari for construction purpose. The DU authorities are not filling up any pond rather they have already allocated over Tk 42 lakh for expanding and protecting a pond in Shivbari area, he added. Advocate Manzill Murshid, president of Human Rights and Peace for Bangladesh, on May 28 filed the writ petition as public interest litigation on the basis of a report published on The Daily Star on May 21 under the headline “DU plans filling of century-old pond”.
