CJ has done discrimination

Chairman of parliamentary standing committee on law ministry Suranjit Sengupta yesterday said the chief justice has done discrimination by not administering the oath to two designated High Court (HC) judges. "If the judges are halted by the chief justice, where the ordinary people of the country would go for justice," questioned Suranjit, adding that the chief justice has left them hanging as they can neither perform judicial functions nor continue with legal profession. He was speaking as the chief guest at a meeting on the occasion of publication of an anthology titled “Recent Appointment of Judges: Not Debate, Attempt to Reach the Truth” organised by Jatiya Ainjibi Parishad at Dhaka Reporters' Unity. The Awami League (AL) lawmaker observed that the crisis has evolved since there is no specific law in this regard, although there is a provision in the constitution of making such a law. “We must go by the law and constitution, otherwise the journey of democracy will be obstructed,” he added. Suranjit, also the co-chair of special committee for constitutional amendment, said the special committee is examining the Supreme Court judgement on the fifth amendment of the constitution. He turned down a request to comment on a remark of former Chief Justice Mahmudul Amin Chowdhury, who at a function on April 24 said the country's judiciary has turned into a glasshouse and it can crumble any time. Presided over by Shah Zikrul Ahmed, MP, the function was addressed by, among others, advocate Yusuf Hossain Humayun, presidium member of AL, Prof Abdus Sobhan, vice chancellor of Rajshahi University and MK Rahman, additional attorney general. On April 11, President Zillur Rahman appointed 17 persons as additional judges of the HC for two years. But the Chief Justice Mohammad Fazlul Karim swore in 15 of them on April 18, leaving out Ruhul Quddus Babu and M Khasruzzaman. The High Court on July 26 stayed for three months the proceedings of a murder case filed in Rajshahi against justice designate Ruhul Quddus Babu.
