HC asks law secy to probe allegations
A High Court bench yesterday directed the law secretary to investigate the allegations against the solicitor's office of not supplying relevant files, records and papers of cases involving the government to the attorney general's office timely.
The main function of solicitor's office is to maintain relevant files of cases involving the government, and supply their necessary papers, documents and records to the attorney general's office for moving those before the High Court and Appellate Division in favour of the state.
The bench of Justice AHM Shamsuddin Chowdhury Manik and Justice Gobinda Chandra Tagore passed the order pointing out that the attorney general's office could not submit the relevant files of some cases before it on time, as it did not get those from the solicitor's office.
A deputy attorney general requesting anonymity told The Daily Star that the HC bench also noted that some of the case files supplied by the solicitor's office did not contain relevant papers and documents.
The bench also asked the law secretary to place the allegations against the solicitor's office before the law minister, and submit the investigation report to it within a month.
It observed that this court has to adjourn hearing of many cases time and again, since the solicitor's office did not supply the relevant files properly to the attorney general's office for placing those before it.
The court has to waste its time and the state's interests are not protected due to adjournments of hearing, it commented.
Attorney General Mahbubey Alam told The Daily Star that there is no necessity to keep the solicitor's office in force, as it does not perform its function properly.
The government should directly send the relevant files, records and papers of cases to the attorney general's office, not through the solicitor, he said.
Asked about the allegations, Solicitor Aminul Islam told The Daily Star that his office always supplies relevant files, records and papers of cases involving the government to the attorney general's office.
“I am ready to reply any question of allegations against my office,” he said.
