Zakir Hossain has been serving a jail sentence for the last five years for a crime he did not commit. He is in Kashimpur jail in Gazipur now serving the life term given to another Zakir Hossain in a murder case. The two men are from Araihazar of Narayanganj city. Based on a newspaper report, the High Court yesterday directed the jail authorities to produce the "innocent" Zakir Hossain before it on July 19. The court also issued a rule asking the officials concerned to explain in two weeks why keeping the innocent Zakir Hossain detained should not be declared illegal. Bangla daily Bangladesh Protidin yesterday published the report . The report says Md Zakir Hossain, son of Shamsul Haque, of Hathkholapara under Araihazar thana in Narayanganj is serving the jail sentence of another Zakir Hossain, son of Shamsuddin, of Beparipara village under the same thana. It also says one Bikchan Mia was killed by some muggers at Bajobi of Araihazar on November 11, 1991. Police in May the next year submitted a charge sheet implicating Shamsuddin's son Zakir Hossain in the case. Subsequently, the District and Sessions Judge of Narayanganj sentenced Shamsuddin's son Zakir Hossain to life in absentia. Failing to arrest the convict, the police on December 10, 2007, arrested Md Zakir Hossain, the report said, adding that the convicted Zakir Hossain was still at large. The HC bench of Justice AHM Shamsuddin Choudhury Manik and Justice ABM Altaf Hossain gave the order following the newspaper report. Home secretary, IGP, IGP (prisons), Narayanganj SP, jail superintendent of Gazipur and senior jail superintendent of Kashimpur jail have been asked to reply the rule.
