SC upholds HC stay orders
The Supreme Court (SC) yesterday upheld the High Court (HC) orders that stayed for three months the suspension of six union parishad (UP) chairmen of Bishwanath upazila in Sylhet.
The upazila nirbahi officer (UNO) of Bishwanath suspended the six chairmen as per a decision of the Ministry of Local Government and Rural Development on July 2 since they were implicated in the charge sheet of a case filed in connection with a clash between two groups of people centring the disappearance of BNP leader M Ilias Ali.
Following separate writ petitions filed by the chairmen, the HC on July 4 stayed the suspension order and also issued six separate rules upon the government to explain why the suspension of the UP chairmen should not be declared illegal.
Meanwhile, the government last week filed six separate petitions with the SC, seeking stay on the HC orders.
A seven-member bench of the Appellate Division of SC, headed by Chief Justice Md Muzammel Hossain, upheld the HC orders after disposing of the government's petitions.
The apex court also asked the counsels of both the state and six UP chairmen to take steps for hearing on the rules issued by the HC on the legality of suspension order for their disposals in four weeks.
The suspended UP chairmen are Mohammad Lilu Miah of Alamkari Union, Nizam Uddin Siddique of Khajanchi Union, Md Jalal Uddin of Bishwanath Union, Kabir Hossain Miah of Lamakazi Union, Md Tahid Miah of Dewkolosh Union and Md Abbas Ali of Dowlatpur Union.
They were accused in the case filed with Bishwanath Police Station on April 23, the charge sheet of which was accepted by a trial court in Sylhet on June 6.
