Fresh Probe into Kibria Murder

Sylhet Divisional Speedy Trial Tribunal Judge Md Mahbubul Islam on Sunday ordered the Criminal Investigation Department (CID) to submit report on the fresh investigation into former finance minister SAMS Kibria killing case to the court by August 12. The tribunal ordered fresh investigation into the case following a petition filed by the then Investigation officer of the case Munshi Atiqur Rahman of CID on March 7, 2007. As ASP Munshi Atiqur went into retirement after a few months, CID's ASP Md Rafiqul Islam was given the task. But CID could not file the report on fresh investigation even in 27 months. Former finance minister SAMS Kibria, his nephew Advocate Shah Manzurul Huda, local AL leaders Abdur Rahim, Abul Hossain and Siddique Ali were killed in a grenade attack on a public meeting at Baidderbazar under Habiganj Sadar upazila on the night of January 27, 2005. ASP Munshi Atique filed a charge sheet with a court on March 20 the same year against 10 including Habiganj BNP leader Abdul Quaiyum. The other accused were, Zainal Abedin, Jamir Ali, Momin Ali, Tajul Islam, Shahed Ali, Chhondu Miah, Selim Ahmed, Enayet Ali and Muhibur Rahman. Complainant of the case Advocate Abdul Majid Khan (now AL lawmaker) filed a 'naraji' petition against the charge sheet the same day. But the magistrate rejected the petition and fixed May 10 for hearing of the case. In the meantime, the case was shifted to the Speedy Trial Tribunal in Sylhet. As the complainant filed a naraji petition with the tribunal, the then judge Biplob Goswami also rejected the naraji petition against the charge sheet in May 2006. The complainant then went to the High Court, which stayed the case proceedings. However, the court vacated the stay order in December last year. On getting bail, Abdul Quaiyum and other accused at a press conference in Dhaka demanded fresh investigation into case, saying that they had been falsely implicated in the case. Kibria's wife Asma Kibria and their son Dr Reza Kibria also demanded fresh investigations into the killing. Asma Kibria filed a petition with the immediate past chief adviser to the caretaker government on January 19, 2007 demanding proper investigation and trial into the case.
