Botched C-Section: HC asks Dr Maksuda to surrender in 4 weeks
The High Court today refused to grant anticipatory bail to Central Hospital's physician Begum Maksuda Farida Akhter Mili in a case filed on charge of negligence of duty during a C-section that led to the deaths of a newborn and her mother.
The newborn of Mahbuba Akter Akhi died while she was undergoing C-section in the hospital on June 10. Akhi, 25, who was taken to LabAid Hospital and had been on life support there, died on June 18.
The HC also ordered Dr Maksuda to surrender before the chief metropolitan magistrate's court in Dhaka in four weeks.
The HC also asked the law enforcers not to harass or arrest her (Maksuda) during this time.
The bench of Justice Md Zakir Hossain and Justice Biswajit Debnath passed the order following a petition filed by the accused physician seeking anticipatory bail in the case, Deputy Attorney General Sujit Chatterjee Bappi told The Daily Star.
Accused Dr Maksuda submitted the bail petition last month to the HC through her lawyers, saying that she was not present in the hospital on June 10 and was not involved in the procuring of the C-section of Akhi.
Petitioner Maksuda appeared before the HC bench during the hearing.
Akhi's husband Yakub Ali filed the case with Dhanmondi Police Station on June 14 accusing the doctors and the hospital authorities of not providing proper treatment during the botched C-section.
Senior Advocate Muhammad Yusuf Hussain Humayun argued for Maksuda.
A Dhaka court on June 15 sent two physicians-Shahzadi Mustarshida Sultana and Muna Shaha to jail in the case.
