Verdict on caretaker government
The Supreme Court of Bangladesh in a landmark verdict has declared the Article related to the Caretaker Government void and at the same time has allowed the next two Bangladesh general elections to be held under the Caretaker Government. This seems to me a bit self-contradictory. I will explain this in an allegorical form.
If we consider the constitution of Bangladesh as a tree with many branches under which the people get shelter, shade, protection and nourishment, could we chop off a branch (article of the Caretaker Government) and ask the people to continue to enjoy the fruits (benefit of Caretaker Government to conduct elections) for the next two general elections? Does it make sense?
If you chop off a branch of a tree, that branch will no longer bear any fruits in the future. If an election is conducted under a void article of the Caretaker Government, will those be valid under the law?
