EC seeks removal of HC stay
Bangladesh Election Commission yesterday filed a petition with the Supreme Court seeking stay on a High Court order which had halted the process for Dhaka City Corporation (north and south) elections.
After a brief hearing, Justice Syed Mahmud Hossain, chamber judge of the Appellate Division of SC, sent the leave to appeal petition to the division's full bench and fixed October 11 for its hearing.
The HC on April 16, following a writ petition, stayed the election process for three months for non completion of the “legal procedures” before holding the polls.
The court on that day directed that the EC, as per the electoral rules, must update the voter lists and the EC and the government authorities should determine the number of wards and councillors three months before the polls.
It had also issued a rule upon the government and the EC to explain why they should not be directed to delimit the DCC ward areas through appointed officials as per the Local Government (City Corporation) Act, 2009 rules.
The Appellate Division on April 19 upheld the HC order.
The HC on July 23 extended its stay order for the next three months.
The petitioner's counsel, Manzill Murshid, said as the SC chamber judge did not stay the HC order, the stay on the election process will be effective till further directives.
