HC for letting Bazlul Haque contest

The High Court yesterday directed the Election Commission to allow independent candidate Bazlul Haque to contest the Gazipur-4 by-election by accepting his nomination paper. The court passed the order after hearing a writ petition filed by Bazlul challenging the legality of the EC's decision to cancel his candidature. Bazlul's lawyer Khurshid Alam Khan said there was now no legal bar to his client's participation in the election scheduled for September 30 following the HC order. On September 5, the returning officer (RO) of Gazipur rejected Bazlul's candidature on grounds that he did not submit his attested educational certificates and the papers showing support of at least one percent of voters of the constituency along with his nomination paper. The independent candidate filed an appeal with the EC on September 7 challenging the RO's order. On September 10, the EC upheld the RO's decision after rejecting his appeal. Bazlul on Monday filed the writ petition with the HC, saying that he had submitted his attested educational certificates and relevant papers showing support of more than one percent of voters along with his nomination paper, but the EC officials did not apply their minds to the papers. Yesterday, a vacation HC bench of Justice Salma Masud Chowdhury and Justice Quazi Reza-ul Hoque passed the order after disposing of the petition.
