Graft Case Against Hasina
HC for not proceeding with her petition
The High Court yesterday granted a prayer for not proceeding with Prime Minister Sheikh Hasina's 2007 writ petition challenging the legality of a corruption case against her under the Emergency Power Rules (EPR).
The prayer stated that Hasina would not run the petition as another HC bench had quashed the case proceedings. Hasina had filed the petition with the HC on October 28, 2007, also seeking bail and for staying the case.
A group of lawyers led by Ahsanul Karim moved the prayer before the HC bench of Justice Farah Mahbub and Justice Abdur Rab.
The Anti-Corruption Commission filed the case with Tejgaon Police Station on September 2, 2007 accusing Hasina and six others of corruption in setting up a barge-mounted power plant in Khulna.
The HC on November 4, 2007 granted the bail, stayed the case and also issued a rule on the government and ACC, asking them to explain why bringing the case under the ambit of EPR should not be declared illegal.
Following another petition, the HC bench of Justice Md Shamsul Huda and Justice Abu Bakar Siddiquee scrapped the case proceedings on April 13, 2010.
Advocate MA Aziz Khan, representing ACC, did not oppose the prayer.
