His witness claims he is innocent
A defence witness yesterday said war crimes accused Khan Akram Hossain was a "victim of previous enmity", while another testified that the accused was "about 14 years old" during the Liberation War.
A prosecution witness of the case, Nimai Chandra, had "previous enmity" with the accused and that is why Nimai filed a case against Akram, said the third defence witness, Abdur Rashid Mollik, 67.
"The case was later transferred to the tribunal," he told the International Crimes Tribunal-1.
According to the prosecution, Akram was commander of the Doiboggohati Razakar camp in Bagerhat.
However, Mollik said Jabbar Molla was the camp's commander and that Akram lived with his uncle Ismail in Khulna, and he returned to his family at Doiboggohati village after the war started.
The fourth defence witness, Yousuf Ali Dihider, 78, gave an almost similar testimony and claimed Akram was about 14 years old in 1971.
But the prosecution which says Akram is now 61, meaning he was 17 years old in 1971, raised an objection, and the tribunal recorded the defence witness's claim with that objection.
Akram, along with two alleged Razakars Sheikh Sirajul Haque alias Siraj Master and Abdul Latif Talukder, is facing seven charges of crimes against humanity and genocide committed in Bagerhat in 1971.
Meanwhile, the tribunal-1 asked prosecutor Syed Sayedul Haque Sumon to reply on Monday to its query -- why the three alleged Razakars were not made accused in the war crimes case against AKM Yusuf though some of the charges are similar in both cases.
Yusuf died in prison on February 9, 2014, and the proceedings against him were later terminated.
The tribunal-1 also asked the prosecutor to reply why some other Razakars who were involved in the atrocities on which the seven charges were framed and who are still alive were not made accused. Meanwhile, the case against two Chapainawabganj Razakars Mahidur Rahman and Afsar Hossain Chutu entered the next stage with completion of the last prosecution witness ZM Altafur Rahman's cross-examination, at the tribunal-2 yesterday.
Ten prosecution witnesses testified on three charges against the duo, and the recording of testimony of the lone defence witness was set for April 12.
