SC allows part of appeal

The Supreme Court has allowed "part" of an appeal filed against a High Court judgment that upheld the government decision cancelling the allocation of frequency to Jamuna Television and stopping its test transmission. A six-member bench of the Appellate Division headed by Chief Justice Md Muzammel Hossain delivered the verdict yesterday, saying, “The appeal is allowed in part." However, the television cannot resume its transmission at the moment, Attorney General Mahbubey Alam, and Ahsanul Karim, a counsel for JTV, told The Daily Star. Details about the part of the appeal allowed by the SC could not be known since the full text of the verdict is yet to be released. Nothing can be said for sure without seeing the copy of the verdict, said Mahbubey Alam. Senior counsels for JTV Rafiqul Huq and Ajmalul Hossain, QC refused to make any comment before seeing the full judgment. The AG, however, said the JTV authorities will get back their equipment confiscated by the government if the apex court permits in the verdict. He said the SC during hearing of the appeal had accepted his arguments for returning those. JTV, a private satellite television channel, began test transmission on October 15, 2009. On November 19 the same year the government stopped its transmission on charge of running without obtaining licence and no objection certificate. The HC in May last year upheld the government decision. The JTV authorities filed an appeal with the SC against the HC verdict.
