Complainant of false case fined
The High Court yesterday fined one person Tk 40,000 for filing a false case against Rajuk chairman and a Supreme Court lawyer to obstruct the compliance of its (HC) order for saving Gulshan-Mohakhali lake in the city.
Delivering a verdict on a writ petition, the court also directed the deputy commissioner of Dhaka to take appropriate action against Abdul Zabbar, the complainant of the case.
Zabbar of Badda in the city filed a criminal case on December 10 last year with the court of an executive magistrate, Dhaka against the Rajuk Chairman Nurul Huda and Barrister Omar Sadat accusing them of grabbing the Gulshan-Mohakhali lake. He also obtained a status-quo order from the magistrate's court that put an end to the excavation of the lake.
Barrister Sadat filed a writ petition with the HC on December 12 the same year challenging the legality of filing the case against them.
The HC bench of Justice AHM Shamsuddin Chowdhury Manik and Justice Jahangir Hossain yesterday delivered the verdict dismissing the case filed by Zabbar.
Following a public interest litigation filed by Barrister Sadat, the HC in May last year asked the government to save the lake and Rajuk to excavate its illegally filled part and create a walkway to demarcate the lake area.
In compliance with the court order, Rajuk started excavating the lake.
