Dispose of rules vis-à-vis Jamaat leaders
The Supreme Court on Thursday directed the High Court to dispose of the rules by December 15 issued over the proceedings against two top Jamaat-e-Islami leaders Motiur Rahman Nizami and Ali Ahsan Mohammad Mojahid in Barapukuria coalmine corruption case.
The HC on November 12, 2008 had issued two rules upon the government and Anti-Corruption Commission (ACC) to explain why the proceedings against Jamaat chief Nizami and its Secretary General Mojahid in this case should not be quashed.
The court also stayed the proceedings against them and granted them bail in this case on the same day.
The ACC on January 18, 2009 filed two leave-to-appeal petitions with the SC against the HC orders.
A seven-member bench of the Appellate Division of SC headed by Justice SK Sinha yesterday passed the order after hearing on the petitions.
The ACC filed the case with Shahbagh Police Station on February 26, 2008, against 16 people, including BNP Chairperson Khaleda Zia, Nizami and Mojahid on charges of causing a loss of Tk 159 crore to the state exchequer by awarding a contract for operating Barapukuria coal mine to a Chinese company through abuse of powers.
ACC counsel Khurshid Alam Khan told The Daily Star that the HC in 2008 had issued separate rules over the proceedings against other accused, including the BNP chairperson, which are pending in the HC.
