A BNP leader filed a writ petition with the High Court yesterday seeking stay on the proceedings of a car torching case filed against 46 opposition leaders, including BNP acting secretary general Mirza Fakhrul Islam Alamgir. Police filed the case with Tejgaon Police Station hours after a vehicle was set ablaze near Prime Minister's Office in the capital during hartal hours on April 29. Metropolitan Magistrate Mohammad Erfan Ullah, conducting the Speedy Trial Court-7 of Dhaka, is scheduled to hear the charge framing on July 31. The petition also challenged whether the chief metropolitan magistrate has the legality to give Magistrate Erfan the judicial powers to conduct the speedy trial court. As per Speedy Trial Act 2002 provisions, only the government could form speedy trial courts and determine the judicial jurisdictions of judges of those courts, said the petition. Barrister Mahbub Uddin Khokon, a joint secretary of BNP and one of the accused, filed the petition.
